Terms of Service for Photography by Alanya

By booking photography services, submitting payment, signing a contract, or using this website, you agree to the following Terms and Conditions.
Photographer agrees to provide professional photography services on the agreed-upon date and within the agreed time frame as confirmed in writing. Coverage includes Photographer’s professional time, talent, equipment, and post-processing consistent with Photographer’s style.
All payments made are considered non-refundable retainers paid to secure Photographer’s time, availability, and services. Services are not reserved or guaranteed until full payment and a signed agreement are received. Photographer is under no obligation to perform services unless payment has been made in full prior to the event.
All sales are final. No refunds will be issued under any circumstance, including but not limited to cancellation, rescheduling, dissatisfaction with images, weather conditions, guest behavior, venue restrictions, or circumstances beyond Photographer’s control.
If Client cancels the event for any reason, all payments made shall be retained. Requests to reschedule are subject to Photographer’s availability and are not guaranteed. Approval of a rescheduled date does not alter the non-refundable nature of payments.
Photographer retains full creative and artistic discretion. Client acknowledges that photography is subjective and that image selection, editing style, composition, lighting, posing, and final delivery decisions are solely within Photographer’s professional judgment. Photographer does not guarantee any specific image, pose, moment, or quantity of images.
Final edited images will be delivered via online gallery within an estimated timeframe. Delivery timelines are estimates and not guarantees. Delays due to illness, emergency, equipment malfunction, data issues, high workload, or other unforeseen circumstances do not constitute breach of contract and are not grounds for refund. No images will be delivered until all outstanding balances have been paid in full. Unedited or RAW files are not provided.
Photographer retains full copyright ownership of all images in accordance with United States Copyright Law. Client is granted a non-exclusive, non-transferable personal-use license to download, print, and share images for non-commercial purposes. Images may not be altered, edited, filtered, sold, published, or used for commercial purposes without prior written consent. Photographer reserves the right to use images for portfolio display, website use, social media, advertising, and marketing purposes unless Client provides written opt-out notice prior to the event date.
Photographer shall not be liable for missed or compromised images due to client lateness, uncooperative subjects, interference from guests, venue restrictions, lighting limitations, schedule delays, or other circumstances outside Photographer’s control. Client agrees to provide a realistic schedule and full cooperation during the event.
In the unlikely event of total photographic failure, equipment malfunction, theft, digital file corruption, data loss, or other technical failure beyond Photographer’s control, Photographer’s liability shall be limited to the return of payments received. Photographer shall not be liable for indirect, incidental, consequential, emotional, or punitive damages.
Client agrees to indemnify, defend, and hold Photographer harmless from any claims, damages, liabilities, injuries, or expenses arising from the event, including but not limited to actions of guests, minors, venue staff, or unsafe conditions.
Photographer reserves the right to terminate services immediately and without refund if working conditions become unsafe, illegal, hostile, or inappropriate, including but not limited to harassment, aggressive behavior, intoxication, or threats directed at Photographer.
Photographer shall not be held liable for failure or delay in performance due to causes beyond reasonable control, including but not limited to illness, medical emergencies, acts of God, severe weather, natural disasters, power outages, government actions, or venue restrictions.
Client is responsible for securing any necessary permits, permissions, or venue approvals required for photography services. Photographer is not responsible for denial of access or restrictions imposed by venues or public locations.
Color representation may vary due to monitor calibration, screen settings, lighting conditions, and third-party printing labs. Photographer is not responsible for color variations or print quality from labs not directly affiliated with Photographer.
Photographer is not responsible for archiving images beyond a reasonable period following gallery delivery. Client is solely responsible for downloading and backing up all digital files upon receipt.
Client agrees not to initiate a chargeback or payment dispute without first contacting Photographer in writing to attempt resolution. In the event of a chargeback, Client agrees to reimburse Photographer for all associated fees, administrative time, and legal expenses incurred in disputing the claim.
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas. Any dispute arising under these Terms shall be filed in the county of Photographer’s principal place of business in Texas.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
These Terms constitute the entire agreement between the parties and supersede all prior communications or understandings. Any modifications must be made in writing and signed by both parties.
By booking services or submitting payment, Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
